USER AGREEMENT

Welcome to the IDENTIA Institute's website (www.identiacentre.net). This website is owned by the IDENTIA Institute. Access to and use of our website are subject to the terms and conditions contained in this User Agreement (hereinafter referred to as “the Agreement”), any other agreements contained in our website and all the laws and regulations in force.

By accessing our website, you agree to observe the terms and conditions described below and waive any and all claims against IDENTIA Institute, its subsidiaries, affiliates, agents and representatives arising out of using our website. If you do not agree with any of these terms, please do not access. Otherwise, you may go ahead, use this website and access any information contained in it.

Your use of our website shall be deemed as proof of your awareness of and agreement with each of the terms and conditions set forth below.

The IDENTIA Institute reserves the right to change these terms and conditions at any time. The user agrees to observe such changes as they may be introduced herein. It is upon the user to monitor any changes and to decide whether or not to continue to access and use the website on the basis of such changes. The website is accessible worldwide at no charge by IDENTIA Institute to anyone with Internet access unless otherwise noted. The user is responsible for all charges imposed by third parties associated with accessing the website, including any computer equipment, telephone or Internet connections and software access.

The materials displayed on and contained in our website (including, without limitation, all editorial materials, texts, photographs, illustrations, artwork and other graphic materials, names, logos, and trademarks; hereinafter “the Materials”) are property of IDENTIA Institute or its licensors and are protected by copyright, trademark and other intellectual property laws.  

2. Display Permission. IDENTIA Institute grants the user the limited right to view the Materials only in his or her personal computer or other personal devices, and to copy and download such Materials provided that: 1) all copyright notices appearing on such Materials are maintained – hiding or removing such notices in any way is strictly prohibited; 2) the download, display, copying or printing of the Materials should be done for personal information purposes only. Such Materials may not be distributed, transmitted, displayed or disseminated in any manner or for any other purposes; and 3) IDENTIA Institute expressly grants permission to view specific materials freely.

The user agrees and undertakes to not modify, edit, alter or change the Materials contained in the publications hosted in or accessible through this website.

The user agrees to not upload or otherwise introduce any software or other materials into this website that may cause damage to computer equipment or the website itself. This includes, but is not limited to, any software or other materials containing viruses, Trojan horses, worms, time bombs, etc. or other computer programming routines or subroutines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information.

The user agrees to not access our website for any unlawful purpose. The user agrees to not transmit, distribute, or store any information, data or other material in violation of any applicable law or regulation (whether bylaw or other rule imposed by any governmental authority).

3. Prohibited actions. All user-provided information and the user's access to this website: a) shall not be fraudulent; b) shall not violate any third party's copyright, patent, trademark, password, or other intellectual property, such as proprietary, advertising or privacy rights; c) shall not violate any law, statute, bylaw or regulation; d) shall not involve any defamation, threat or harassment; e) shall not contain any viruses, Trojan horses, worms, time bombs, cancel bots or other computer programmes or routines that directly or indirectly result in damage, detrimental interference with, surreptitious interception of or expropriation of any equipment, system, data or personal information; and f) shall not violate any IDENTIA Institute Policies relating to this website. In any of the above-described instances, user's access to the website may be blocked or terminated immediately by IDENTIA Institute.

4. Right to Terminate User/Remove Content. IDENTIA Institute reserves the right to automatically terminate the user's limited access right, without notice, should the user breach any of the terms and conditions set forth in this agreement and in the website. Except as expressly stated herein, the user acknowledges that he or she has no legal right, entitlement or share regarding the Materials, other than a limited right of access and purchase, as provided by law (especially all statutes regulating intellectual property rights). IDENTIA Institute may suspend or terminate user's access to this website if user chooses to market or trade in our users' data or transfers data to any site or venue other than IDENTIA Institute. IDENTIA Institute reserves the right to discard or remove any data or materials without notice should they pose a problem or risk for IDENTIA Institute.

5. Termination of restricted access . Should a member-only access be established, the user will be authorised to access the website for the period for which IDENTIA Institute provides a valid password. IDENTIA Institute reserves the right to terminate user's access at any time and without notice, for any reason or for no particular reason.

6. Limitation of Liability. Your use of the website is at your own risk and responsibility. Neither IDENTIA Institute nor any of its subsidiaries, divisions, affiliates, agents, representatives or licensors shall be liable to any user or anyone else for any loss, injury, or direct, indirect, incidental, punitive or similar damages should any action based on this Agreement result in negligence or any other legal issues, arising out of your access or use of, or your ineptitude to access or use, the website and the information contained therein or arising out of any action taken in response to or as a result of any information contained in the website. You hereby waive any and all claims against IDENTIA Institute and its affiliates, agents, representatives and licensors arising out of your use of the website and the information available therein.

7. User information. Any information or material that the user sends or transmits to or through this website is and will be considered not confidential and unpatented. The user accepts full responsibility for any sent or transmitted material or communication and grants IDENTIA Institute and its affiliates the rights of edition, copy, publication and distribution of any information or content sent or transmitted by the user for any reason. This does not apply to personal details as set forth in our Privacy Policy.

8. Disclaimer . The IDENTIA Institute, its subsidiaries, divisions, affiliates, agents, representatives and licensors refuse responsibility for the suitability or appropriateness of the content contained in this website. All such content is provided “as is”, without justification or authorisation of any kind. The IDENTIA Institute, its subsidiaries, divisions, affiliates, agents, representatives and licensors refuse responsibility for any opinion, advice, announcement, or statement appearing in the website; such responsibility pertains to the authors of the relevant information or materials.

9. Links to/from other websites. The IDENTIA Institute and its affiliates do not review or monitor any websites linked to our website and thus are not responsible for the content of any such linked websites. Your use of such websites is at your own risk.

10. Voluntary Disclosure of Personal Information . The user should be aware that voluntary disclosure of personal information (e.g., user name, e-mail address) in a form, chat room, or otherwise involves the risk that third parties beyond our control might collect and use such information, resulting in unsolicited messages for which the IDENTIA Institute is not liable. IDENTIA Institute collects personal information that you choose to provide on our website. IDENTIA Institute uses this information for internal purposes, to sporadically send you information about IDENTIA Institute and its publications or other topics. If you would like to change any of the information that you have provided to IDENTIA Institute , or if you would like to be removed from the IDENTIA Institute mailing list, please contact IDENTIA Institute at identia@identiacentre.net

11. Security Passwords . The user accepts entire responsibility for any password issued to him or her. The user agrees to immediately notify IDENTIA Institute if such password is lost, stolen, disclosed to an unauthorized third party or otherwise may have been compromised. The user agrees to immediately notify IDENTIA Institute of any other breach of security in relation to our website that is known to you. The user is entirely responsible for any and all activities involving the personal password, even if performed by others.

12. Severability . If any provision hereof is held invalid or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity or enforceability of any other provision and such invalid provision shall be deemed to be severed from the Agreement.

13. General considerations . A) Our Website contains information (including pricing or costs information) concerning IDENTIA Institute products and/or services and such information may contain typographical inaccuracies or other errors. IDENTIA Institute reserves the right to make changes to this information, at any time and without notice. Your continued use of our website will be deemed to be an acceptance of any modification to the terms of this Agreement made by IDENTIA Institute; B) This Agreement and any disputes arising out of or related to the Website shall be governed by, and construed and enforced in accordance with, the Spanish and EU laws and all international treaties signed by Spain related to intellectual property; C) If you refuse or fail to abide by the terms and conditions of this Agreement, IDENTIA Institute reserves the right to suspend or terminate your access to contents of our Website; D) The parties User and IDENTIA Institute are independent. Neither party may direct or control the day-to-day activities of the other; neither party may create or assume any legal obligation on behalf of the other nor shall this agreement be construed as creating any agency, partnership or joint venture between them; E) IDENTIA Institute shall provide notice to User via email or via conventional mail, to the address provided in the registration form or such other address provided by User to IDENTIA Institute; F) This Agreement, including the website's Privacy Policy, constitutes the entire general user agreement between User and IDENTIA Institute and supersedes any prior agreements or understandings between User and IDENTIA Institute. No amendment or modification hereof will be valid or binding upon either party unless made in writing and signed by the authorized representatives of both parties and; G) User acknowledges and agrees that this Agreement shall in no event be construed as a third party beneficiary contract and that it is not intended for the benefit of any person or company whomsoever except the parties hereto.

User acknowledges that he or she has read this Agreement, understands it and agrees to abide by its terms and conditions. User also agrees that this Agreement is the complete and exclusive statement of the Agreement between User and the IDENTIA Institute and supersedes all proposals or prior endorsements, oral or written, and any other communications between you and IDENTIA Institute or any representative of IDENTIA Institute relating to the subject matter of this Agreement.

 

PRIVACY POLICY

  The Privacy Policy of IDENTIA Institute may change from time to time so please re-visit this notice periodically.

  User information policy

IDENTIA Institute is committed to respect and protect the personal information of each and every person who visits this website and grants that all personal information on operations done in this website will comply at all times with the recommendations established by the “Agencia de Protección de Datos” ( Information Protection Agency ) and by the law. The personal and/or financial information that the user voluntarily gives to IDENTIA Institute as a consequence of a financial transaction or operation will not be disclosed or sold to third parties in any case. This information will be safeguarded to avoid being accessed by unauthorized individuals.

All statistical and aggregate data –excluding personal information- from transactions and operations done by IDENTIA Institute are property of IDENTIA Institute. IDENTIA Institute will use this information as may deem fit.

  General terms

By visiting the website of IDENTIA Institute , the user agrees to abide by the following TERMS AND CONDITIONS.

All Users must make an appropriate use of this website and its contents. IDENTIA Institute WILL NOT be responsible for damages arising out of or caused by the use of the information contained in it. Orders

Orders can be placed online through the website of IDENTIA Institute or by e-mail, letter, fax or phone. In all cases IDENTIA Institute reserves the right to accept the order.

Pricing Policy

The prices and costs of the products may be increased as appropriate according to tax requirements, handling costs, shipping, etc. In all cases all added costs will be displayed during the automated purchasing process in the webpage. IDENTIA Institute reserves the right to not ship an order in the event of mistaken prices or error in the systems that calculate added costs or taxes.

Paying Methods

Ordered items are shipped right after full payment completion. For online orders, just follow the guided payment process, which depends on the selected payment method.

Delivery of Tangible Items or Goods

Orders are delivered in compliance with the stated deadlines, which run starting on the payment day. Delivery timeframes are indicated before payment. Delivery dates should always be taken as approximate. IDENTIA Institute will do its best to honour them. Nevertheless, a delivery delay will not imply cancellation of the order and does not give the User the right to receive compensation.

Deliveries are considered “completed” upon receipt of the product and signature of the delivery note by the addressee. Should the received items differ from those stated in said delivery note, the addressee may file a complaint within seven (7) days after the delivery.

Shipping costs are on the User, unless expressly stated otherwise.

IDENTIA Institute is not responsible for any damages caused during the shipment, except for items carried by IDENTIA Institute personnel.

Product Information

The images that illustrate the products may not be exactly identical to the product itself due to unexpected changes, error, or faulty web configuration. Therefore, the images are not binding and involve no commitment for IDENTIA Institute .

Returns Policy

The purchase of a product implies and constitutes a donation (equivalent to at least the item's cost price). We do not accept returns, in other words, we do not return donations.
